Ocean Lakes student accused of circulating nude images of classmates

VIRGINIA BEACH, Va. (WAVY) – A former Ocean Lakes High School student is accused of distributing pornographic images of at least five classmates.

The Virginia Beach Commonwealth’s Attorney’s Office charged the juvenile Nov. 15 with two counts of distributing child pornography. The incident happened on Dec. 10, 2015, when the student was a 17-year-old junior at the school.

The female victims contacted school administration when they found out their nude photos were being shared around school, according to court papers.

The principal says the juvenile suspect admitted in an interview to sending and receiving pictures of female students and storing them in a “secret vault app disguised as a calculator.”

“It was just me being driven by pure corruption of the mind, and I just followed it,” said the juvenile to a disciplinary committee in January.

The committee first recommended expulsion, but they ultimately voted to transfer the student to Kempsville High School.

The suspect’s lawyer, Kevin Martingayle, raised concerns about the district’s investigation in January. He argued there are no nude photos in the case file, however district officials claim to have seen the photos in question.

Martingayle also told the disciplinary committee that he believed the district did not have jurisdiction to transfer the juvenile because there is no evidence the activity happened on school property or during school hours.

The Commonwealth’s Attorney’s Office says the juvenile was released Tuesday on a $2,500 bond.

The student will be arraigned on Nov. 28.
