COLORADO SPRINGS, Colo. (WAVY) — A non-custodial father accused of taking his child from the child’s mother and legal guardian was captured by U.S. Marshals in Colorado Tuesday.

The child was unharmed.

On June 21, a felony warrant was issued for 47-year-old John Francis Rose’s arrest. Rose is accused of violating a court order over custody and visitation, taking his child from the child’s mother and legal guardian in Norfolk and leaving the state.

Norfolk police launched an investigation and soon discovered Rose had already left his Elizabeth City, North Carolina home. Marshals were asked to help find Rose and the child, who authorities believed was not in any danger. Marshals learned that Rose had fled to Colorado during the investigation.

Rose was taken into custody around 4:30 p.m. Tuesday as he walked out of a Wal-Mart in Colorado Springs. The child was with him, and was turned over to Child Protective Services until they can be reunited with the mother.

Rose is being held at the El Paso County Jail in Colorado Springs.
