EL DORADO, Kan. (KSNW) – A man whose pistol allegedly discharged during a high school graduation ceremony last month made his first appearance in court Wednesday.

Gary S. Funderburg-Atherton is charged with aggravated battery and illegally discharging a firearm in the city.

Investigators say Funderburg-Atherton had a gun concealed inside his sock at the Augusta High School graduation on May 15th when it went off while he was adjusting it.

The bullet fired from the .380 caliber handgun struck Atherton and a woman who was sitting nearby. Both of them suffered minor injuries.

Funderburg-Atherton’s preliminary hearing is scheduled for August 8th.
