NORFOLK, Va. (WAVY) – New details are emerging following a car accident that sent a 7-year-old boy to the hospital with serious injuries.
Nasair Smith was hit by a car on West 38th Street off Colley Avenue on March 31. He has been in the hospital since the crash.
Witnesses told WAVY News 10 Smith was playing at a nearby playground last month when he went to cross the street and was hit by an SUV. Smith was taken to the Children’s Hospital of the King’s Daughters, where he was in critical condition for weeks.
The Police Crash Report from the accident notes the driver was in a 2004 Ford Escape when Smith was hit. 10 On Your Side is not mentioning the driver’s name because the driver has not been charged with a crime. The Police Crash Report also states the driver did not act improperly, and was going the speed limit at the time of the crash. Police said the driver had not been drinking or driving distracted.

In the description of the crash, police noted Smith attempted to cross the street from behind a parked car, meaning the driver likely didn’t see the child when he walked into the street.
No charges have been filed in the case, and police say it remains under investigation.
Smith is still at CHKD recovering, but his aunt told WAVY News 10 he is no longer in intensive care. Smith is also breathing on his own now.
