VIRGINIA BEACH, Va. (WAVY) — The man found not guilty of decapitating his 5-year-old son appeared in court Tuesday for an annual review.

Thirty-nine-year-old Joseph Henry Hagerman III was found not guilty by reason of insanity in May 2009. He has been held in the custody of the state’s mental health system since February 12, 2009 — two days after he killed his son and injured his wife, who tried to save the child.

On February 10, 2009 police were called to Hagerman’s home on Sugar Creek Drive just after 11 a.m. It’s then that officers made the grim discovery — Hagerman’s 5-year-old son, Joseph Hagerman, had been decapitated.

During a jailhouse interview with WAVY.com, Hagerman admitted to killing his son and claimed he took his son’s life to save him from evil.

Hagerman has been reviewed every year since August 2009 to see if any progress has been made in his condition, enough for him to stand trial. His next review is set for February 2015, after which his reviews will be every two years.
