Lawmaker calls for impeachment of judge in same-sex marriage case

RICHMOND, Va. (WAVY) — Monday saw new opposition to a federal judge’s ruling that struck down Virginia’s same-sex marriage ban.

Delegate Bob Marshall released a statement calling for the impeachment of Judge Arenda Wright Allen, chastising the way she and gay marriage supporters are going about changing the voter-approved law.

“Legislating through the Courts against the will of the people is lawless disregard for our representative form of government,” Marshall said in the statement. “… If same-sex marriage proponents want to take down legitimately passed laws and Amendments, then they should attempt to do so without using an end run against the legitimate legislative process.”

Marshall represents the 13th District, which includes parts of Prince William and Loudon counties, and was one of the authors of the Marshall-Newman Marriage Amendment to the Constitution of Virginia that defined marriage as between one man and one woman. That amendment was approved by Virginia voters in 2006.

Last week, Judge Wright ruled the amendment unconstitutional. Opponents of same-sex marriage plan to appeal the decision.
